GENERAL TERMS & CONDITIONS OF SALES
1. PURCHASE ORDERS FOR GOODS
1.1 Purchases can only be accepted for delivery within 6-8 weeks time.
1.2 Each purchase from Compumart shall be deemed to incorporate these terms and conditions. These Terms & Conditions of Sales might change from time to time at sole discretion of Compumart.
1.3 The display of products in our brochure and on our website www.malajham.com constitute an invitation to trade and not a formal offer. Goods are sold only subject to availability. An offer to buy will be made by the customer by following the steps to order on the website with the full payment received with an email confirmation to both the seller and the buyer. An offer is only accepted by www.malajham.com subject to availability of stock and www.malajham.com is contractually only bound when it emails a confirmation of order to the customer clearly stating the delivery date.
2. PRICES AND PAYMENT
2.1 Payment shall be made in AED/US$ only. All prices are subject to change by an advance notification on www.malajham.com website.
2.2 Goods are delivered within 6-8 weeks upon confirmation and receipt of the payment. The buyer may expect the goods to be delivered earlier but not later.
2.3 Goods once confirmed and sold will not be taken back or exchanged. Warranty for the goods is between the manufacturer and the customer as per the terms mentioned on the invoice order forms. All shipping charges for returns and exchanges of goods under the warranty period are to be borne by the customer. The customer needs to ship out the defective goods under warranty to Compumart and once the defective goods have been received, arrangements will be made to ship out the new replacements for goods under warranty only.
2.4 Ownership of goods shall not pass to Customer until www.malajham.com has received cash or cleared funds for the full price.
2.5 Compumart reserves the right to refuse and to cancel an account and/or delivery at any time. In such circumstances, if the Customer has paid for relevant goods, a refund or credit note shall be issued.
3. DELIVERY
3.1 Compumart undertakes all efforts to deliver goods 6-8 weeks from date/time of confirmation or delivery time mentioned in the order confirmation as per section 1.3 hereunder. All invoices/delivery notes must be signed by an adult aged over 18 years or over on delivery; if no one is at the address when the delivery is attempted the goods may be retained by the shipping company. All extra storage charges incurred for this delay will be borne by the customer. Compumart will not be responsible for any charges incurred due to the delays made by the customers.
3.2 Each order shall constitute a separate contract.
4. WARRANTIES AND LIABILITIES
4.1 Compumart accepts no liability for defects in goods resulting from customer designs or requirements, wrong storage, wrong handling or arising from wear and tear, willful damage, negligence or misuse.
4.2 Information on www.malajham.com or in our brochure may contain inaccuracies or typographical errors. Information and product specifications, including information relating to price and availability may be changed or updated without notice. No guarantee is given that the information accessible via www.malajham.com or displayed in our brochure is accurate, complete or current. Nothing on www.malajham.com or in our brochure shall be construed as a condition, warranty or representation.
4.3 Except as otherwise stated in these terms, Compumart’s entire liability in respect of a particular good that has passed into the ownership of a customer and the customer' remedies, shall be limited to, at Compumart’s option, and in accordance with its returns policy from time to time, a credit note in respect of the amount paid by the customer to Compumart for such good; or the replacement of the good by Compumart.
4.4 In case of any defects or damages Customer shall at earliest convenience, however not later than 14 days after defect or damage has incurred, inform Compumart. Compumart accepts no liability and or responsibility of any kind for any kind of defect in goods sold to Customer if (a) Compumart has not been informed accordingly, and or (b) the defective goods and are not kept, isolated and handed to Compumart for inspection.
4.5 Compumart shall have no liability to the Customer for indirect or consequential loss. This warranty is exclusive, and in lieu of all other warranties, express or implied, including warranties of merchantability and fitness for a particular purpose. |
